TRADER29 TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your use of Trader29, available at www.trader29.com and related Trader29 services (the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1) Who we are

2) Nature of the Service
Trader29 is an online community and marketplace tool that enables users to list, discover, discuss, and coordinate trades relating to in-game or virtual items and services.

Trader29 provides software, communication tools, marketplace discovery tools, community features, safety tools, support tools, and reputation signals. Trader29 does not own, sell, transfer, store, verify, or control any in-game item. Trade posts are user-generated and trades take place between users outside Trader29’s direct control.

Trader29:
• Is not a party to any trade between users
• Does not take possession of items
• Does not guarantee completion, item quality, item availability, user honesty, trade safety, legality, or game publisher compliance
• Does not guarantee that trade posts, reviews, profiles, reputation scores, badges, blacklist results, or social content are accurate or complete

Users trade at their own risk.

No affiliation: Trader29 is not affiliated with, endorsed by, sponsored by, or officially connected to Bethesda, ZeniMax, Microsoft, Fallout, Fallout 76, or any game publisher/platform holder. All trademarks belong to their respective owners.

3) Eligibility and accounts
You must be at least 18 years old to use the Service.

You are responsible for:
• Maintaining the confidentiality of your login credentials
• All activity conducted under your account
• Providing accurate, current, and complete information
• Keeping platform handles/gamertags accurate where you choose to provide them
• Using the Service only in a lawful and responsible way

We may refuse, suspend, restrict, or terminate accounts that provide false information, impersonate others, evade moderation, or breach these Terms.

4) User Content
You may post trade posts, profile information, store content, images, messages, support tickets, reports, reviews, social posts, comments, replies, and other content (“User Content”).

You confirm that:
• You own or have permission to use the content you submit
• Your content does not violate law, third-party rights, privacy rights, platform rules, or these Terms
• You will not submit false, misleading, malicious, abusive, illegal, or harmful content

You grant Trader29 a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, moderate, adapt for formatting, and use your User Content solely for operating, securing, moderating, promoting, and improving the Service.

We may remove, hide, restrict, or moderate User Content at our discretion where we believe it breaches these Terms, the Acceptable Use Policy, law, safety standards, or platform integrity.

5) Marketplace conduct
You agree:
• Not to misrepresent items, value, availability, ownership, quantity, trade terms, or trader identity
• Not to scam, harass, manipulate, threaten, pressure, deceive, or exploit other users
• To comply with applicable game publisher rules, platform rules, law, and community standards
• Not to trade prohibited, illegal, restricted, stolen, duplicated, hacked, or unsafe content
• Not to use Trader29 to arrange trades that breach publisher rules or law
• To use trade rooms, messages, reviews, social tools, support tickets, and reports honestly

We may issue warnings, restrict features, close or lock trades, remove trade posts, remove content, suspend accounts, ban accounts, or take other action for violations.

6) No real-money trading or external payment arrangements
Users must not use Trader29 to arrange real-money trading, cash sales, account sales, external payment requests, off-platform payment requests for in-game items, or any transaction that violates applicable game publisher rules or law.

Trader29+ subscriptions and any official Trader29 fees are payments for Trader29 platform features only. They are not payments for in-game items and do not make Trader29 a party to user-to-user trades.

7) Trader29+ fees and subscriptions
Certain features may require payment, such as Trader29+ or other paid platform features.

By purchasing a subscription or paid feature:
• You authorise us or our payment provider, such as Stripe, to charge applicable fees
• Billing may occur on a recurring basis unless cancelled
• You are responsible for keeping payment information up to date
• You may manage or cancel your subscription through the billing portal where available
• Cancellation takes effect at the end of the current billing period unless stated otherwise or required by law
• Access to paid features may end, reduce, or change when your subscription ends, payment fails, or a charge is reversed

Unless required by law, subscription fees are non-refundable once paid. Nothing in these Terms affects any cancellation, refund, cooling-off, statutory, or consumer rights you may have under applicable law.

We may change subscription pricing, limits, or features with reasonable notice where required. If you do not agree to a pricing or feature change, you may cancel your subscription.

8) Courier, protected trade, and safety tools
Trader29 may offer courier requests, protected trade tools, trade locking, trade completion, trade closing, reporting, blacklist, block, mute, moderation, or other safety features.

These tools are community safety and platform integrity tools only. Unless expressly stated otherwise, Trader29 does not act as an escrow provider, payment intermediary, financial service, broker, agent, guarantor, insurer, or trustee. Trader29 does not guarantee that a courier/protected trade will complete safely or successfully.

Couriers, admins, moderators, and safety tools may help coordinate or review issues, but users remain responsible for their own trade decisions.

9) Reviews, reputation, badges, and disputes
Ratings, reviews, badges, completed trade counts, reputation signals, and profile/store information are provided for community context only. They do not guarantee trustworthiness, accuracy, safety, performance, or future behaviour.

You must not manipulate reviews, badges, reputation, likes, comments, follows, trades, reports, or marketplace activity.

Trader29 may provide reporting, dispute, support, or moderation tools, but does not guarantee specific outcomes. We may temporarily restrict accounts, threads, features, trade posts, or content during investigations.

10) Blacklist, reports, and safety records
Trader29 may maintain safety records, scam reports, moderation notes, blacklist entries, account restrictions, platform handles, evidence/context, and related records where we believe this is necessary to protect users, prevent abuse, enforce rules, or maintain platform trust.

Public blacklist entries may include platform handles, reasons, evidence/context, or other relevant safety information where appropriate. Users must not submit false, malicious, doctored, misleading, retaliatory, or bad-faith reports.

We may restrict or remove access to the Service where we believe a user presents a safety, scam, abuse, legal, or platform integrity risk.

11) Social and community features
Trader29 may provide social posts, comments, replies, likes, feeds, news, store attachments, trade post attachments, follows, and other community features.

Social and community content must follow these Terms and the Acceptable Use Policy. We may remove, hide, restrict, rank, collapse, moderate, or disable social/community content or accounts at our discretion.

You must not spam feeds, manipulate engagement, brigade users, harass traders, repeatedly advertise unrelated services, or use social features to pressure users into trades.

12) Prohibited activities
You must not:
• Attempt to hack, reverse engineer, scrape, overload, spam, interfere with, or disrupt the Service
• Use bots, automation, scripts, scraping, or data extraction without permission
• Exploit bugs, vulnerabilities, or unintended behaviour
• Evade bans, blocks, mutes, restrictions, limits, or moderation actions
• Impersonate another person, company, admin, courier, moderator, Trader29, or any partner
• Claim, imply, or suggest that Trader29 sponsors, endorses, partners with, approves, or is affiliated with your group, store, page, service, social account, community, or content unless we have given written permission
• Use Trader29 branding, logos, screenshots, name, goodwill, or content in a way that suggests sponsorship, partnership, endorsement, official approval, or misleading association without permission
• Share private personal information of others without consent
• Submit false reports, fake evidence, malicious tickets, or doctored screenshots
• Engage in illegal activity through the Service

13) Moderation and enforcement
We reserve the right, at our discretion, to:
• Remove, hide, edit for safety, or restrict content
• Restrict marketplace, messaging, social, support, courier, review, or account features
• Close, lock, or mark trades
• Suspend or terminate accounts
• Remove paid feature access where rules are breached
• Preserve safety, moderation, or dispute records
• Cooperate with law enforcement, regulators, courts, or authorities where legally required or appropriate

We aim to act reasonably and proportionately, but we may act without notice where we believe safety, security, legal compliance, or platform integrity requires it.

14) Account deletion, suspension, and content retention
You may stop using the Service at any time. You may contact support about account deletion or data requests.

If your account is suspended, terminated, restricted, or deleted, some content or records may remain visible or retained where necessary for marketplace integrity, dispute handling, safety, moderation, fraud prevention, legal compliance, accounting, reputation history, blacklist/safety records, or legitimate business reasons.

Deleting your account does not automatically remove all reviews, trade history, moderation records, reports, blacklist entries, dispute evidence, or other records where retention is necessary.

15) Service availability and changes
The Service is provided “as is” and “as available.”

We may modify, suspend, limit, replace, or discontinue features at any time. We may also impose or change usage limits, membership limits, trade post limits, rate limits, or safety restrictions.

We are not responsible for downtime, data loss, bugs, delays, service interruptions, provider outages, or loss of access except where required by law.

16) Disclaimers
To the maximum extent permitted by law, we do not guarantee:
• Trades will complete successfully
• Users are trustworthy or accurately represented
• Trade posts, prices, values, images, stock, item details, or availability are accurate
• Items or services will meet expectations
• The Service will be uninterrupted, error-free, secure, or available at all times
• Safety tools, courier tools, blacklist checks, reports, reviews, or moderation will prevent all scams or harm

Users trade and interact at their own risk.

17) Limitation of liability
To the maximum extent permitted by law:

• Trader29 is not liable for losses arising from user-to-user trades, scams, failed trades, misinformation, user conduct, in-game penalties, publisher enforcement, loss of virtual items, or off-platform interactions.
• Trader29 is not liable for indirect, consequential, special, incidental, or punitive losses, loss of profit, loss of goodwill, loss of data, loss of opportunity, or loss of reputation.
• Our total liability relating to the Service is limited to the amount you paid us in the 12 months preceding the claim, or £0 if you paid nothing.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or other liabilities that cannot legally be excluded.

18) Privacy
Your use of the Service is governed by our Privacy Policy, which explains how we collect and use personal data.

19) Third-party services and links
The Service may rely on or link to third-party services such as Supabase, Vercel, Stripe, Resend, Cloudinary, analytics providers, game platforms, social platforms, or external communities.

We are not responsible for third-party services, websites, content, outages, charges, rules, or privacy practices.

20) Governing law
These Terms are governed by the laws of England and Wales.

Courts of England and Wales shall have jurisdiction, except where consumer protection law provides otherwise.

21) Changes to these Terms
We may update these Terms from time to time. Where changes are material, we will make reasonable efforts to notify users through the Service or by other appropriate means.

Continued use of the Service after updates constitutes acceptance of the revised Terms.
